Terms of Use

These Terms of Use ("Terms") are a binding agreement between you and Burbia ("Burbia," "we," "us") that governs your access to and use of burbia.ai and any Burbia product or service (together, the "Services"). By using the Services you agree to these Terms.
1. What Burbia is and is not
Burbia is a discovery tool that helps you explore and compare neighborhoods and suburbs using public data, proprietary scoring, and an AI-assisted chat experience.
Burbia is not a real estate broker, agent, MLS, appraiser, lender, mortgage broker, title company, escrow agent, attorney, tax advisor, or financial advisor. Burbia does not list properties for sale or rent, does not represent buyers or sellers, and does not hold any real-estate license unless and until explicitly stated in writing by an affiliated licensed brokerage. Nothing we provide is legal, tax, or financial advice.
2. Eligibility and accounts
You must be at least 18 years old and capable of forming a binding contract. You are responsible for keeping your account credentials confidential and for activity under your account. Notify us promptly at hello@burbia.ai if you suspect unauthorized access.
3. AI chat experience: disclosures and accuracy
The chat experience is powered by a large language model. You are interacting with software, not a human real-estate professional. Responses are generated automatically and may be incomplete, inaccurate, or out of date. The Services do not guarantee the availability, price, tax, school, commute, crime, or other characteristics of any neighborhood or property.
Verify anything material with an authoritative source (school districts, county records, MLS, tax assessor) and with a licensed professional in the relevant field before making a decision. Your reliance on any AI-generated content is at your own risk.
4. No brokerage, fiduciary, or agency relationship
Use of the Services does not create a brokerage, agency, fiduciary, employment, or advisory relationship between you and Burbia. Any real-estate professionals you are introduced to through the Services are independent businesses. Burbia does not control their conduct and is not responsible for the services they provide.
5. Referral relationships
Burbia may receive a cooperating-broker referral fee from licensed partner brokerages for transactions originated through the Services. Any such fee is paid broker-to-broker at closing by the settlement agent. It is not an additional charge to you and is not paid from your funds. Burbia does not control or set the commissions charged by any real-estate professional. Burbia does not receive anything of value from title companies, escrow agents, lenders, or other settlement-service providers in connection with your transaction, and does not steer you toward any specific settlement-service provider.
We will disclose any specific partner relationship at the point where it becomes relevant to you, for example when we introduce you to a cooperating broker.
6. Data sources and limitations
The Services rely on public data sources (US Census, federal and state agencies), third-party data providers, and our own scoring models. Information may be delayed, incomplete, or contain errors. You are responsible for independently verifying schools, taxes, transit, zoning, housing conditions, HOA rules, and any other factors before making a decision.
7. Fair housing and acceptable use
You may not use the Services to discriminate, or to solicit recommendations that include or exclude people based on race, color, national origin, religion, sex, familial status, disability, or any other class protected by federal, state, or local fair-housing law.
You also may not: (a) attempt to extract protected-class information about any neighborhood from the AI; (b) reverse engineer, scrape, or bulk-copy our data or scoring models; (c) use the Services to harass or impersonate; (d) upload malicious code; or (e) use the Services in violation of applicable law.
Burbia reserves the right to refuse or suspend access for any use that violates this section.
8. Intellectual property
Burbia and its licensors retain all right, title, and interest in the Services, including software, content, design, scoring methodology, and brand elements. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes. You may not copy, reverse engineer, redistribute, or create derivative works except as allowed by law or by our prior written permission.
9. User feedback
If you send us suggestions, feedback, or ideas about the Services, you grant us a royalty-free, worldwide, perpetual license to use them without obligation to you.
10. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. BURBIA DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT RECOMMENDATIONS ARE ACCURATE, OR THAT DATA IS CURRENT.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BURBIA AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, WHETHER IN CONTRACT, TORT, OR ANY OTHER THEORY. OUR AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
Some jurisdictions do not allow certain limitations; in those jurisdictions, the limitations apply to the maximum extent permitted.
12. Indemnification
You will indemnify and hold Burbia harmless from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising from (a) your breach of these Terms, (b) your violation of applicable law, or (c) your infringement of any third-party right.
13. Third-party services
The Services may link to or integrate with third-party services (for example, maps, email, authentication). Third-party services are governed by their own terms and privacy policies; we are not responsible for their conduct or content.
14. Termination
You may stop using the Services at any time. We may suspend or terminate access for any reason, including a violation of these Terms, with or without notice. Sections that by their nature should survive termination will survive (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, and Miscellaneous).
15. DMCA / copyright
We respond to valid notices under the Digital Millennium Copyright Act. Send notices to legal@burbia.ai including the information required by 17 U.S.C. § 512(c)(3).
16. Governing law and dispute resolution
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. You and Burbia agree that any dispute will be resolved in the state or federal courts located in Delaware, and each party consents to personal jurisdiction there. This section does not waive any right you have under applicable consumer-protection law to bring a claim in your home jurisdiction.
17. Changes to these Terms
We may update these Terms from time to time. If we make material changes we will post the new version here and update the "Last updated" date. Continued use of the Services after the change constitutes acceptance.
18. Miscellaneous
These Terms, together with the Privacy Policy and any written agreement you enter into with Burbia, are the entire agreement between you and us on this subject and supersede prior discussions. If any provision is held unenforceable, the rest remains in effect. We may assign these Terms to an affiliate or successor; you may not assign without our written consent. Failure to enforce a provision is not a waiver.
